Having Delaware car insurance is important if you want to be able to drive legally in the state. You can now buy this insurance online. However, you are first advised to get a free Delaware car insurance car insurance quote by using the form above.

It’s fast and it’s free. Just make sure you have the insurance you need before you start driving on the road. The state does not look kindly on drivers who have failed to purchase proper insurance.

This is because of the number of auto accidents that occur each and every day. State government’s including Delaware have made insurance policies mandatory in order to protect those drivers who are hurt of injured in accidents.

Minimum Auto Insurance Requirements In Delaware

It is thus very important that you fully understand the minimum amount of mandatory auto insurance you are required to have in Delaware. There are three parts to all Delaware insurance policies that are mandatory. In insurance speak you need 15/30/10 liability coverage along with Personal Injury Protection coverage.

In plain English you’ll need to make sure you have at least the following 3 things:

  1. Bodily Injury Liability Insurance:
    • $15,000 for injury or death to one person in an accident;
    • $30,000 for injury or death to all people in an accident, with no more than $15,000 for any one person;
  2. Property Damage Liability Insurance:
    • $10,000 for damage to another person’s property in an accident;
  3. Personal Injury Protection (PIP) Coverage:
    • $15,000 for one person in an accident towards medical bills and lost wages
    • $30,000 for all people in an accident towards medical bills and lost wages, with no more than $15,000 for any one person;
    • Also includes $5,000 for funeral expenses.

The Delaware Insurance Commissioner notes that these mandatory limits are quite low and that you should strongly consider additional liability insurance. Moreover, they list a few other optional coverage options that are also recommended for you and your car.

Delaware State Auto Insurance Laws

Delaware takes the issue of uninsured drivers very seriously. It is against the law not to meet your insurance requirements as a driver. Worse yet since Delaware is a fault state, if you get in an accident and don’t have insurance you will be personally liable for all costs, which will most likely bankrupt you.

You are required by law to show valid proof of insurance to a law enforcement officer if they ask. The penalties for not having insurance are very steep compared to other states. They are as follows:

  • A fine of no less than $1,500 for a first conviction;
  • $3,000 fine for each subsequent convictions within 3 years;
  • Driver’s license and driving privileges will be suspended for 6 months following each and every conviction.

The DMV conducts random audits on vehicles registered in the state. If you are asked to show proof of insurance you’ll have to get in contact with your insurer to get form FR-19, your Delaware Insurance Certification. It just states that your vehicle has been continuously insured since the policy was purchased and remains in force.

If you fail to comply with the audit, your vehicle registration and driver’s license will be suspended until such time as you can show proof of insurance. Assuming you were in fact covered during this time you’ll face reinstatement fees of $25 per driver’s license and $50 per vehicle registration. If your insurance lapsed or was in any way not in full force you’ll be faced with the penalties listed above.

Finally, once your policy has been issued your insurer can’t cancel it without good cause. Most commonly this happens because the policyholder fails to pay their premiums. Other reasons can include getting your license suspended or revoked, failing to report something your supposed to, to your insurer (for example an accident) and/or misrepresenting yourself when you applied for insurance.

If for any reason your insurer does cancel your policy you should get a new one as soon as possible. The following company listings may be of help in such a situation.

Average Delaware Auto Insurance Rates

The Insurance Commissioner has a list of things that can be used to determine your premium rates in Delaware. Your age, gender, vehicle and marital status can all be used in addition to your driving history to determine the rate insurers are willing to offer you.

The bad news for you is that average Delaware insurance rates are among the highest in the whole country. The Insurance Information Institute has found the state to be the 6th most expensive in the whole country in 2008. Annual premiums that year were $1,007 for the state.

Younger drivers who tend to use online quote services are paying even more. For 2011, is seeing average premiums of $2,111 for drivers who use their site. This is much higher than their overall average of $1,441. This is probably not the overall average, but still shows that the state is disproportionately expensive.

Delaware Car Accident Statistics

One small contributing factor to the higher rates, may be the slightly higher than average fatality rate found on Delaware’s roads. Based on statistics from the Delaware Office of Highway Safety and the National Highway Traffic Safety Administration the state is consistantly slightly more dangerous to drive in then the national average.

In 2009 there were 116 traffic fatalities in Delaware or 1.28 for every 100 million vehicle miles traveled in the state. The US average in comparison is 1.14. This means the fatality rate in Delaware is about 12% above the national average. Part of the issue is the fact that drinking and driving is more common in the state than elsewhere. 45 deaths in 2009 were cause by drunk drivers which represented 39% of all fatalities. The US norm is 32%.

Given how small Delaware is these are not great figures. In terms of counties New Castle County was the most dangerous followed by Sussex County in the middle with Kent County being the safest. No matter where you live, drive safely, don’t speed and certainly don’t drink drive. By being a safer driver you can help Delaware reduce the number of crashes and deaths on the roads each year.
